B. The State / Union Territory /
Metro Committee may, with the previous sanction of the National
Committee, change its Headquarters.
C. The National Committee may, after ascertaining the wishes of
the State Committee or Committees concerned, constitute a New
State/ Union Territory / Metro Committee, abolish an existing
State / Union Territory / Metro Committee, merge any existing
State / Union Territory / Metro into one or assign to a State /
Union Territory / Metro, a District or a portion/s of a District
from any other State or Metro.
D. The National Committee shall have the power to give
representation in such manner as it thinks proper to areas in
the Union of India as have not been included in the jurisdiction
of any State / Union Territory / Metro Committee and/or direct
that such an area or part thereof be included in a neighboring
State / Union Territory / Metro.
ARTICLE IX
MEMBERSHIP
1. Any Indian citizen of the age of 18 years or above who
accepts Articles IV, V and VI of the Constitution of the Party
shall, on making a written declaration in the Membership Form
(Form-A) and on payment of a prescribed subscription, becomes a
member of the Party, provided that he/she is not a member of any
other political party, communal or other, which has a separate
membership, constitution and programmes;
2. No person shall become a member except in his / her place of
permanent residence or where he / she carries on his / her usual
vocation but at one time he / she shall not be a member at more
than one place.
3. The term of membership will ordinarily be of six years (or as
decided by the National Executive from time to time).
4. With the beginning of the new term all members of the party
will have to fill membership forms again to become a member.
5. The member will have to apply in writing to the State / Union
Territory / Metro / District Level Committees concerned for a
change of address/ place.
6. Membership will cease by death, resignation or removal.
The subscription received by members shall be distributed in the
following proportions among the various Committees :
National Level Committee : 10%
State / UT / Metro Level Committees : 15%
District Level Committees : 25%
Subordinate Committees : 50%
ARTICLE X
ACTIVE MEMBERS
A. To become an active member of the Party -
1. The membership of the party should not be less than two
years.
2. He / She will deposit an amount of Rupees Five Hundred
(personally or by collection) alongwith his / her active
membership form.
3. He will devote not less than thirty days in a period of one
year for the Party as per the direction of
National/State/UT/Metro/District Committees.
B. TRAINING FOR ACTIVE MEMBERS :
1. Every active member shall undergo a minimum training as may
be prescribed by the National Executive Committee.
2. No active member shall be entitled to contest for the
election to :
i) National Level Committee,
ii) State/UT/Metro Level Committee,
iii) Executive of the District Level Committee,
iv) Parliament, the State Legislature, Metropolitan Council or
Local Bodies contested on Party Ticket unless he/she undertakes
to undergo a minimum training as may be prescribed by the
National Executive Committee.
3. No person shall be selected for election on party ticket to
Parliament, State Legislature and Local Bodies unless he/she is
an Active Member.
C. RENEWAL OF ACTIVE MEMBERSHIP : Active Membership may be
renewed by filling up the membership Renewal Form.
ARTICLE XI
TERM : The term of each Council/Executives, Committee and all
office bearers and members shall ordinarily be two years.
ARTICLE XII
REGISTER OF MEMBERS
A. A register of members of local Committee area wise shall be
prepared by the Subordinate Committee duly authenticated and
certified by the District Executive in accordance with the rules
prescribed by the National Executive. A copy of verified
Membership Register will be sent to the concerned Local
Committee and District Committee.
B. The register so prepared shall contain the full name,
father’s / husband’s name, age, occupation, address, serial
number of membership form and the date of enrolment of every
member as well as the year and membership form number of his
first enrolment in the Indian National Green Party.
ARTICLE XIII
CONTRIBUTION TO THE PARTY FUND
A. Each active member shall have to contribute to the Party Fund
certain percentage of his income, as prescribed in the rules by
the National Executive Committee.
B. Contribution from the Autonomous Body of the Party to frame,
design, collect funds and implement the programmes of the Party
and in the interests of the country.
C. By way of accepting gift, grants, donations, contribution/
subscription for the promotion of the Party and in the welfare
of the people.
ARTICLE XIV
Subordinate/Local Committee
A. Subordinate/Local Committee shall have atleast twenty five
members. But where the population of the area is less than one
thousand, the number of members shall be atleast fifteen.
B. The President and members of a Subordinate/Local Committee,
which shall have atleast one women member will be elected by all
the members of the area as prescribed by the rules.
C. The President will appoint a Secretary from among the members
of the Committee.
ARTICLE XV
District Committee
A. District Committee shall consist of a President and not more
than twenty five members, at least two women and two belonging
to SC/ST Members of all the elected Subordinate/Local Committee
in the District shall elect the President and members of the
Committee.
B. The President of the District Committee shall nominate the
office bearer and from amongst the elected members i.e., two
Vice-Presidents, one General Secretary, one Treasurer, and two
Secretaries. Out of these office bearers at least one shall be a
women and atleast one belonging to S.C and S.T.
C. With the prior consent of the State/Metro President, the
District President can appoint one or more General Secretary
(Organisation) even from outside the elected members of his
Committee. He will be a full member of the Committee.
ARTICLE XVI
STATE/METRO COUNCIL
A. A State/UT/Metro Council shall consist of :
1. Members elected by the District Units as laid down in
sub-clause (B).
2. 10% of Party Legislature to be elected by all the members of
the Legislative Party, but not less than ten; if the total
number of Legislators is below ten, then all of them.
3. 10% of Party Parliament Members from the State, but not less
than three. If the number of Parliament Members from the State
is less then three, then all of them.
4. All members of the National Council from the State.
5. All former State Presidents.
6. All members of the State Executive.
7. All office bearers of the Regional Council.
8. Leaders of the Party in State Assemblies and State Council.
9. President and General Secretaries of the District Committees.
10. Party President of the Subordinate Committees.
11. Nominated Members not more than ten by the State President.
12. State President of Cells and Morchas, if any.
B. Each District shall elect members for the State Council equal
in number to the number of seats in the State Assembly allocated
to that District provided that these elected members shall
include a minimum number of persons belonging to S.C./S.T. equal
to the Assembly seats reserved for them from that District. If
the members so elected do not include a women member and if all
the seats of the District are reserved, then one additional
women member and one additional representative not belonging to
S.C./S.T. shall be elected for the State Council from that
District.
C. Each Member of the State Council shall pay a fee of Rs. One
Hundred.
ARTICLE XVII
STATE EXECUTIVE
A. The State Executive shall consist of a President and not more
than sixty members, at least five of whom shall be women and
five belonging to the S.C./S.T., to be nominated by the State
President.
B. The President shall be elected by members of the State
Council from categories (1), (2) and (3) of Article XVI (A) as
per rules prescribed by the National Executive.
C. The President would nominate from among the members of the
Executive not more than five Vice-Presidents, three General
Secretaries, one Treasurer and five Secretaries. Out of the
office bearers at least one has to be a women, one S.C. and one
S.T.
ARTICLE XVIII
NATIONAL COUNCIL
A. The National Council shall consists of :
1) Members elected by the State Council as laid down in
sub-clause (B);
2) 10% of the Party members of Parliament, but all upto ten;
3) All former National Presidents;
4) All State President;
5) Leaders of the Party in Lok Sabha and Rajya Sabha;
6) Leaders of the Party in State Assemblies and Councils;
7) Nominated members (not more than twenty) by the National
President;
8) All members of the National Executive; and,
9) All India President of Morchas and Cells.
B. Members of the State Council comprised in Categories (1) (2)
and (3) of Article XVI (A) shall elect members for the National
Council equal to the number of Lok Sabha seats allocated to that
State, provided that these members shall include a minimum
number of persons belonging to S.C./S.T. equal to the number of
seats reserved for them from that State/UT/Metro.
C. Every member of the National Council shall pay a fee of
Rupees two hundred.
ARTICLE XIX
ELECTION OF THE NATIONAL PRESIDENT
A. The National President shall be elected by an Electoral
College consisting of :
1) Members of the National Council as mentioned under Article
XVIII, A (1)and (2).
2) Members of the State Councils as mentioned under Article XVI,
A (1), (2) and (3).
B. The election shall take place in accordance with the rules
framed by the National Executive.
ARTICLE XX
NATIONAL EXECUTIVE
A. The National Executive shall consist of the President and not
more than seventy five members, of whom at least seven shall be
women and seven belonging to S.C./S.T., to be nominated by the
President.
B. The President shall nominate from amongst the members of the
National Executive not more than five Vice Presidents, not more
than five General Secretaries one of these to be General
Secretary (Organisation), one Treasurer and not more than five
Secretaries. Out of the office bearers at least two shall be
women and two belonging to S.C/S.T.
ARTICLE XXI
TERM OF THE PRESIDENT
A. No member will hold the post of a President consecutively for
more than three full terms.
B. The State and the National President will have at least 25 %
new members in his Committee.
C. The number of Special invitees in a Committee shall not
exceed 50% of its total strength besides ex-officio permanent
invitees.
ARTICLE XXII
PLENARY SESSION
A. A Plenary Session of the Party shall ordinarily be held once
in two years at the time and place decided upon by the National
Executive.
B. The following shall be entitled to attend the Plenary Session
of the Party :
1) All members of the National Council;
2) All members of the State/UT/Metro Council;
3) All members of the Party in Parliament;
4) All members of the Party in State Legislature; and,
5) All other categories agreed upon by the National Executive
for the Session.
C. The National President shall preside at the said session.
ARTICLE XXIII
SPECIAL SESSION
A. A Special Session of the Party will be held, if the National
Executive so decides or if at least hundred members of the
National Council jointly make a request to the National
President to convene a Special Session for discussing an agenda
specified in the demand.
B. All members of the National Council shall be delegates for
the Special Session.
C. The National President shall preside at the said session.
D. Such a Session shall be organised by the State Council of the
State selected for holding the Sessions.
ARTICLE XXIV
POWERS AND JURISDICTION
A. All decisions taken at a Plenary Session or a Special Session
shall be binding on all Units, Organs, Morchas, Cells and
members of the Party.
B. Subject to the decisions mentioned in sub-clause A, the
National Council shall be the highest policy making body of the
Party.
C. Subject to sub-clause A and B, the National Executive shall
be the highest authority of the Party. Every power not
specifically vested in any other organ shall be exercisable by
the National Executive. It shall lay down rules for carrying out
the functions of all units / organs. It shall frame rules for
the maintenance of funds which will be audited and approved
annually. It shall be duty of the National Executive to allocate
the powers of all other units and organs, to frame rules, to
create machinery for holding elections and for settlement of
disputes therefrom.
D. All other organs and units shall perform such functions and
carry out such duties in their respective areas as may be
determined by the National Executive.
E. The National Executive shall set up a Parliamentary Board
consisting of the Party President as Chairman, for the purpose
of regulating and co-ordinating the Parliamentary activities of
the Party and shall frame rules in that behalf. One of the
General Secretaries shall be nominated as Secretary of the
Parliamentary Board by the President.
ARTICLE XXV
CENTRAL ELECTION COMMITTEE
A. The National Executive shall set up a Central Election
Committee consisting of the Parliamentary Board and eight other
members elected by the Executive as per rules, for the purpose
of -
1) Making final selection of candidates for the State
Legislatures and Parliament; and,
2) Conducting Election Campaigns.
ARTICLE XXVI
STATE ELECTION COMMITTEE
A. By framing necessary rules the State Executive shall elect a
State Election Committee of not more than fifteen members.
1) To propose names of Party Candidates for Legislature and
Parliamentary seats from the State to the Central Election
Committee.
2) To make final Selection of Party Candidates for the various
Local/Subordinate Body Elections, Co-operative Institution and
like.
3) To conduct election campaigns in the State.
ARTICLE XXVII
TECHNICAL / PROFESSIONAL CONSULTANCY WING
A. The Technical/Professional Consultancy Wing / Division /
Committee is a autonomous body with eleven elected members from
and amongst technical / professional members of the party.
B. It shall consist of five hundred technical / professional
members of the Indian National Green Party, who will be
consulted by the Party in all technical matters relating to
welfare of the people and the nation.
C. The Objects for which the Technical/Professional Consulting
Wing of the Party has been established are :
a) Progress through collective wisdom.
b) A commitment to gainful employment, education and
environment.
c) To establish Central Data Base set for providing information
analysis, condensation repackaging and wide dissemination of
Agro-Industrial Information through publications, seminars,
workshops, lecture, discussion, round table conferences on
typical subjects at the national and international level.
d) To develop various kind of courses and programmes often
tailored to the needs of specific groups.
e) To desgin foundation, appreciation, tntensive courses,
orientation, training and attachment programmes to users in all
round development of India in the welfare of the people.
f) To function as a nodal agency for building a sustainable
society.
g) To provide a thorough grounding to the participants so as to
improve their functional skills, widen their horizon and enable
them to sharpen their perspective through exchange of views and
experience and above all induce inspiration for development of
the India in the welfare of the people.
h) To embark upon several multi-dimensional cross country
programmes of training of trainers for a variety of vocational
trades in the rural areas for employment generation on
sustainable basis.
i) To provide professional services and training facilities in
the areas as under :
(1) General surveys and studies on national resources,
geological surveys, market surveys, sectional studies.
(2) Project Identification, preparation and evaluation,
opportunity studies, techno-economic feasibility, technical and
economical evaluation.
(3) Manufacturing technology product design, production
planning, quality, laboratory testing.
(4) Product handling packaging and exporting.
(5) General Management Service.
(6) Construction projects, supporting industrial activities,
environment, solar power, water resources, mineral resources,
energy, economic and social studies and software development.
(7) Forecasting, marketing, production, planning and management,
maintenance, quality control, productivity and information
management.
(8) Training, research, consultancy, organisation of awareness
action programmes, publications, production of electronic
equipments / materials / computer aided evaluation and
monitoring in all areas for development of the nation.
(9) Implementation of programmes having a positive, social,
educational, cultural and economic content for building a
sustainable society.
j) To serve as a forum for exchange of ideas and experience and
collection and dissemination of information on the aforesaid
topics and its monitoring control, impact assessment,
information awareness, law, policy, research promotion and
training in particular.
k) To aid in organising conferences, seminars, meetings,
discussions, debates, collection of statistical exhibition for
the promotion of the aims and objects of the party consultancy
wing.
l) To conduct sponsored as well as non-sponsored research
programmes with the support of Union Government, State
Government, Business Association, Industrialists, Foreign
Organisations etc in the interests of the nation and in the
welfare of the people.
m To develop all Parliamentary Constituencies of the nation with
the help of people and to promote economic upliftment movement.
D. The Chairperson of the Technical / Professional Consultancy
Wing shall be elected from and amongst the technical /
professional members of the Executive Body of the Wing of the
Party.
E. Membership fees of the Technical / Professional Consultancy
Wing shall be Rupees Five hundred at present.
F. The decisions of the Technical/ Professional Consultancy Wing
of the Party in technical matters shall be final and binding on
the Party.
G. The aims and objects of the Technical / Professional
Consultancy Wing shall be decided by its own Executive Body
meetings with two-third of members present and voting at the
meeting.
H. The Technical / Professional Consultancy Wing shall maintain
/ raise / acquire / build / separate office, accounts and check/
audit etc. from time to time by its separate unit / division of
the consultancy wing.
I. The Technical / Professional Consultancy Wing shall accept
fees, gift, grants, donations, contribution/ subscription for
the promotion of the Party and in the welfare of the people and
nation.
J. The Consultancy Wing shall maintain ten percentage of total
income for functioning of the Party and spend rest for
contesting the elections. The ninety percentage of funds shall
be kept by the Consultancy Wing and not transferred to the
National / State or District Council or Executive in any manner
whatsoever but strictly spend to contest the general election
either of State or Nation, in addition to ten percent for
function of the Party.
ARTICLE XXVIII
SCRUTINY OF REGISTER OF MEMBERS
The State Executive and the District Committee shall undertake
periodic scrutiny of the ten year term Register of Members
maintained by each Subordinate Committee and shall dispose off
all complaints regarding irregularities and rectify the records.
If large scale irregularities are reported, the National
Executive may take such action as it considers necessary.
ARTICLE XXIX
MORCHAS AND CELLS
1. Women’s, Youth, Student, Industrial Workers, Teacher, Freedom
Fighter, Ex-Servicemen, Kisan, Minorities, Schedule Caste and
Schedule Tribes Morchas will be constituted at all levels; and
cells formed at the National, State and District level for other
fields, according to the rules framed by the National Executive.
2. The National President of the Indian National Green Party
shall nominate All India Presidents for all Morchas and Cells.
3. The Morchas and Cells will be constituted at all levels to
cater to the interests of Ex-soldiers, Traders, Employees,
Labour, Washermen, Weavers, Cattle Breeders, Fishermen,
Juggi-Jhopri dwellers, Hawkers, those working in cooperatives
etc.
4. Funds of the Morchas cells will be collected in Party
Receipts.
5. The Office bearers of the Party will be constituted by the
President of the Morchas and Cells as per the Party
constitution.
ARTICLE XXX
VACANCIES
A. The office of a member or a delegate of any Committee or
Cell/Morchas constituted under this Constitution shall be
vacated by resignation, removal, or death.
B. All vacancies shall, unless otherwise provided for, be filled
in the same manner in which the vacated member was chosen and
member so elected shall hold office for the un-expired term of
the seat vacated.
C. In the absence of any provision to the contrary, a Committee
/ Council / Executive, once it is properly constituted shall not
become invalid by reason of any vacancies.
ARTICLE XXXI
MISCELLANEOUS
A. No person shall be a member of any two Committees.
B. A Committee may delegate any of its power to a smaller
Committee or an individual.
C. Population figures of the last available census shall be the
basis for all Party purposes.
D. Where there is a question of the value of fractions, a
fraction of one-half or more shall be treated as one, and less
than half as zero.
E. The Subordinates Committees shall elect from amongst its
members the Presidents, Vice-Presidents and Treasurers and
members of their Executive Councils / Committees, the Presidents
of the respective Committees shall appoint Secretaries.
F. Any question or dispute arising under the Constitution with
regard to provisions, contents, interpretations or the
procedures laid down therein, between members and Committee /
Council / Executives shall be determined by the appropriate
authorities indicated in this Constitution, and the decision of
such an authority shall be final and binding on all members and
Committees of the Indian National Green Party, and shall not be
liable to question by any of them in a Court of law.
G. Any member who does not attend three successive meetings of
any Party Committee/ Council/ Executive without prior intimation
of his absence shall cease to be a member of the Committee/
Council/ Executive concerned.
ARTICLE XXXII
ELECTION DISPUTES
Subject to the rules framed by the National Executive,
State/Metro Executive and District Committees shall make
arrangements for dealing and disposing off all disputes out of
elections to Units and Organs within their jurisdiction.
ARTICLE XXXIII
AMENDMENT OF THE CONSTITUTION : The Constitution can be amended,
altered and added to, only by the National Council of the Party,
provided that the National Executive shall have the powers to
amend, alter and add to this Constitution also. The changes so
made by the Executive shall be placed before the very next
session of the National Council for ratification, but they may
come in operation even before such ratification from a date as
may be prescribed by the National Executive.
Rules of Indian national Green Party
UNDER ARTICLES IX, X AND XII
1. Membership Forms of the Party shall be printed by the
respective State/UT/Metro Units only.
2. Membership Forms shall be serially numbered. After a six year
term, the serial number will again be from 1. They shall carry
the signatures of the respective State/UT/Metro President.
3. Membership forms shall be issued in the form of books of not
less than ten and not more than hundred forms each.
4. A District Unit shall primarily be responsible for the
enrolment of members in the District. The State Units shall
issue membership forms to the District Units. As a special case,
membership forms will also be issued to individual members who
is member of the Party but not more than fifty forms shall be
issued at one time. Additional membership form shall be issued
to the individual who is member of the Party only when full
account of the forms already issued is rendered and fees
deposited. If there are complaints that any District Unit is not
issuing forms properly, the State Unit, after due verification
of facts may issue forms to the Party Units or individuals who
are members of the Party and inform the District Unit concerned
accordingly.
5. When membership forms are issued to the individuals or
Committees, a signed acknowledgment shall be obtained in all
cases and an undertaking to return the unused forms with proper
accounts, whenever called upon to do so, should be obtained. In
the event of any individual failing to return the unused forms
and/or accounts of used forms in time he/she shall be
disqualified from contesting organisational elections for that
term.
6. The District Committees/Units shall prepare the list of
members for every term, local committee/subordinate committees.
New members enrolled shall be added to the list. In a detailed
proforma of the total number of members, each Subordinate
Committees would send to the State Office. While preparing the
proforma the number of those members who have died or resigned
or were removed during the term would also be mentioned and
their number reduced from the total list.
7. In order to give the Party a well informed and members
ideologically Oriented Cadre, the Party members at all levels
shall participate in the study programme laid down by the
Working Committee for Members.
8. Active member forms will also be printed by the State Unit.
The Completed forms received by the Subordinate Unit from the
members would be forwarded to the District Party Office for
their approval. The approved forms would be sent to the District
Office where a list of active members would be prepared. Copies
of these lists would be sent to the State and Centre. No member
of the Party can enroll in more than one place.
9. If a member wants a change of place he/she will have to apply
under Article IX (A) (5).
10. The amount received by the State from District active member
forms would be distributed as under.
Subordinate 10%
District 15%
State/UT/Metro 15%
National 25%
Reserved for Central Election Fund 35%
11. The State shall immediately send to the National Level
Committee its share of the contribution i.e 35% for the Central
Election Fund and 25% for the National Committee. The State
shall also send the share of the Districts Committee/
Subordinate Committees to the respective districts.
12. Any State or its subordinate unit which fails to comply with
these rules shall be liable to disciplinary action.
13. Rules for disposal of objections or appeals there from for
the preparation of electoral rolls will be framed by the
National Executive.
14. For the Party Elections, generally every two years. The
National Executive would prepare the time table.
15. Area of enrolment of member and active members shall be
confined to the State / UT concerned.
16. Renewal of Membership of a person will be deemed to have
been completed by depositing biennial subscription of Rs Ten as
membership fee. The deposit of fee shall be entered in the
permanent register in the column specified for this purpose
against the name of each number. The member depositing the fee
shall be given a separate receipt of payment. Such receipt books
shall be printed and supplied by the State Committee.
17. Identity Cards to each Active Member with his/her photograph
pasted on it will be issued. The Card will bear signature of the
President of the District/UT/State concerned.
18. The following shall be the minimum tasks for Active members
of the Party :
a) Enrolment of Members and Active Members.
b) Collection of Party Funds.
c) Training Programmes of political and ideological study as
directed by the National Executive from time to time shall be
applicable to Active Members / Office Bearers of the Party.
Failure to participate in the programmes so laid down may
attract disqualification for holding office in the Party
Organisation.
d) Enrolment of subscribers to the Party periodicals published
by any Party Executive or any periodical recognised by the State
Executive concerned.
e) Work in the field of social reforms, such as work against
dowry system, child marriage, social exploitation, child labour,
exploitation of women and work for family planning etc.
f) All members should usually use swadeshi goods or articles.
g) All members shall promote one or more of the following
constructive activities :
i) Environmental Purity.
ii) Agricultural Development.
iii) Education.
iv) Prohibition.
v) Khadi and Village Industry.
vi) Organisation of Youth and Students.
vii) Organisation for Women.
viii) Organisation for retired Armed Forces Personnel.
ix) Organisation for Free Legal Aid.
x) Organisation for Old Aged Persons.
xi) Organisation for Freedom Fighters and their family.
xii) Organisation of Labour.
xiii) Organisation of Kisans.
xiv) Small Savings Campaign.
xv) Village Sanitation, Health and Hygiene.
xvi) Rashtrabhasha Prachar.
xvii) Promotion of Co-operatives.
xviii) Work on the Constituencies.
xix) Leprosy Work.
xx) Welfare of Scheduled Caste and Scheduled Tribes.
xxi) Welfare of Women, Child and Old aged Persons.
xxii) Removal of untouchability.
xxiii) Work for National Integration- work among minorities.
xxiv) Adult Education and Library Movement.
xxv) Any special programme as may be laid down by the National
Executive or Technical/Professional Wing of the Party under the
Constitution.
UNDER ARTICLE XIV :
SUBORDINATE/LOCAL COMMITTEE
1. The Subordinate/Local Committee will be the basic unit of the
Organisation.
2. A Subordinate/Local Committee shall, as far as possible,
correspond to the area or territory falling under one Polling
Booth or Polling Station in the General Election.
3. All members of the Subordinate/Local Committee shall meet at
an appointed time, date and place, fixed for elections.
Candidates will file their nomination papers one hour before the
time of poll.
4. The President of the Subordinate/Local Committee shall be
elected from amongst the active Members. Any local member can
seek election to the Membership of the Executive Committee.
5. The election of the President and Executive Members of the
Subordinate/Local Committee shall be by show of hands.
UNDER ARTICLE XV :
DISTRICT COMMITTEE
1. Election for the District Committee and State Council Members
to be elected from that District will be held only when 50% of
the total Subordinate/Local Committee in the District have been
duly constituted.
2. A candidate for election to a District Committee should
ordinarily be resident of the District Concerned.
3. Voting in the election of Members of a District Committee by
the unit members of the Subordinate/Local Committee shall be by
ballot.
CONDUCT OF ELECTION
1. The National Executive shall appoint a Returning Officer for
conducting the biennial election of the Party.
2. The All India Returning Officer shall appoint a Returning
Officer for each State for the conduct of elections up to the
District Committee and members of the State Council from those
Districts. The State Returning Officer will in turn appoint
Assistant Returning Officer for conducting Subordinate/Local
Committee elections. There will be no bar for State Returning
Officer to be a candidate for the National Council.
3. Election disputes during election upto the Subordinate/Local
Committee would be decided by the District Returning Officer.
These must be submitted within three days of the disputes. They
will be disposed off within seven days. Appeal will lie with the
State Returning Officer within ten days.
4. Election disputes during election upto the District level
Committee and State level Committee would be decided by the
State Returning Officer. These must be submitted within five
days of the disputes. They will be disposed off within ten days.
Appeal will lie with the All India Returning Officer within
fortnight.
DISCIPLINARY ACTION
1. Disciplinary Action Committee of not more than five members
will be constituted by the National and State Executive
respectively at the National and State Levels. These Committees
shall draw their own procedures.
2. A State Disciplinary Action Committee can take action only
against Subordinate/local Committee to it and individuals other
than Members of the National Council and Members of Parliament.
3. On receipt of a complaint for breach of discipline, the
National President or the State President, if he/she so decides
may suspend an individual or a unit.
4. No final decision for breach of discipline shall be taken
against any individual or a unit without an opportunity being
given to the individual or unit concerned to explain and answer
such charge as are made against it or him/her.
5. The State President will forward the said complaint alongwith
the explanation received thereto by the individual or the unit
to the Disciplinary Action Committee which will submit its
report to the President as early as possible.
6. The State President will ordinarily take action consistent
with the recommendation of the Disciplinary Action Committee.
But if he/she so desires he may refer the said report for the
consideration of his Executive and thereafter action will be
taken according to the decision of the Executive.
7. Any disciplinary action at the State level shall be reported
to the National President within a week of taking such action.
8. Any unit or member aggrieved by the disciplinary action taken
by the State Unit may go in appeal within a fortnight to the
Central Disciplinary Committee, but any appeal against the
decision of a State Executive will be considered only in a
meeting of the National Executive.
9. Any member contesting election against the official candidate
of the Party will be summarily expelled from the Party by the
State President or the All India President.
POWER OF SUSPENSION
1. The National President can place under suspension any
Council/Executive subordinate to the National Executive and any
member of the Party if there is a prima facie breach of
discipline. The President should place this matter before the
next meeting of the National Executive.
2. The President of the State Executive can place under
suspension any Executive/Council, any member but not the member
of Parliament or National Executive. All disputes relating to
suspension shall be placed before State Executive and
proceedings should be initiated so as to dispose of disciplinary
action case within one month of the suspension order.
BREACH OF DISCIPLINE
Breach of discipline includes the following :
1. Acting or carrying on propaganda against any programme or
decision of the Party.
2. Opposing the Official Candidate of the Party in Elections.
3. Violating any rule or disobeying any order passed by a
competent authority of the Party.
4. Taking a Party dispute to any other agency outside the Party.
5. Collecting Funds for the Party unauthorisedly, misusing the
Party or indulging in malpractices in enrolment of members or in
the conduct of Party Election.
6. Acting in a way calculated to lower the prestige of the Party
or carrying on propaganda against any Party Unit or its Office
Bearers.
SITTINGS
1. Sitting of the various units of the Party shall ordinarily be
held at least as under :
a) National Council - Once in a year.
b) State Council - Once in a year.
c) National Executive - Twice in a year.
d) State Executive - Twice in a year.
e) Regional Committee - Once Every Three Months.
f) District Committee - Once Every Three Months.
g) Subordinate/Local Committee - Once in a month.
2. In case no meeting of a Regional, District or
Subordinate/Local Committee is held even once in six months, the
unit will automatically stand dissolved. If a unit becomes
inactive, the State Executive will have the power to dissolve
the unit upto District Level after giving it an opportunity to
explain.
3. The State President will nominate an ad-hoc body to look
after the work of the dissolved unit. Normally, elections will
be held within three months of the ad-hoc arrangement. But, if
even after six months a duly elected unit is not formed, the
earlier announced ad-hoc body shall be replaced by another
ad-hoc arrangement.

VACANCIES
1. Members absenting without approval for three consecutive
meetings of their unit will be liable to be removed by a
resolution of the concerned unit.
2. President of a Local, District or a Regional Committee can be
removed by a resolution passed by a two third majority of the
members present and voting in a meeting of the unit concerned.
3. A President can remove an office-bearer nominated by him/her
only after a motion to the effect is adopted by his/her
Committee.
4. The All India President or a State President can be removed
by a resolution passed by a two third majority of the members
present and voting at a requisitioned meeting of the National or
the State Council as the case may be.
5. To fill vacancy in any Committee or a Council the remaining
elected members of that body will be entitled to fill the
vacancy. But vacancy in the number of women, SC/ST members will
be filled up by members belonging to the respective categories
only.
6. Vacancy of the President of any unit will be filled in the
same manner as was done originally, till then an ad-hoc
appointment will be made by the President of the higher body who
in turn will nominate his/her office bearers from amongst the
members of the existing Committee/Executive.
7. No post will remain vacant for more than six months.
QUORUM
1. Quorum for all Committee/Executive meetings shall be
one-third of the strength of the unit or ten, whichever is less.
2. Quorum for all Council meetings will be one-tenth of the
total strength of the Council. A meeting adjourned for lack of
quorum will meet again after the same lapse of time at the same
place and time to transact the same business.
Provided that there shall be no need of a quorum for an
adjourned meeting.
DELEGATE
A delegate shall not be permitted to take part in any session or
meeting of the Council unless he/she pays the requisite delegate
fee.
REPRESENTATION OF MORCHAS AND CELLS
The Presidents of all approved Morchas and Cells of the Party
shall be permanent invitees of the corresponding Indian National
Green Party Executive Committee.
FUNCTIONING OF CELLS AT DISTRICT LEVEL
The District Executive shall constitute the following Cells :
a) A Student Cell.
b) A Youth Cell.
c) A Kisan Cell.
d) An Industrial Cell.
e) An Industrial Workers Cell.
f) A Teachers Cell.
g) A Women’s Cell.
h) A Scheduled Caste and Scheduled Tribe Cell.
i) A Freedom Fighter Cell.
j) A Minority Cell.
k) A Free Legal Aid Cell.
FUNCTIONS OF THE OFFICE BEARERS / PRESIDENT
1. To preside over the sittings of the concerned Committee or
Council or Executive.
2. To nominate, as per the Constitution, members/office bearers
and members of the Committee/Executive.
3. To exercise any power of his/her Executive/Committee, in an
emergency, when it is not in session provided that any such
action will have to be approved in its subsequent meeting.
4. To allocate the work and duties amongst the office-bearers
and members of the Committee/Executive/Council.
5. To take part in talks, discussions, debate with other parties
and to nominate representatives from the Party for the work.
6. To decide the date of the Committee/Executive meeting and to
convene the meeting as per rules of the Party Constitution.
7. To conduct Study Camps and Conferences as organised by the
Committee/Executive.
8. To appoint Presidents for the various Morchas and Cells of
the Party and to co-ordinate their functioning.
9. To guide the Committee/Executive in implementing programmes
for furthering the organisational and constructive activities
and agitational programmes of the Party.
10. The Presidents of the various units will be authorised to
spend upto the following amounts on their own:
President of Subordinate/Local Committee : Rs. 1000/-
President of District Committee : Rs. 5000/-
President of Regional Committee : Rs. 5000/-
President of State/UT Executive : Rs. 25,000/-
National President : As considered advisable.
If under any unavoidable circumstances, amount more than
authorised is spent, it would be essential to get the necessary
approval at the very next meeting of the Committee/Executive.
VICE-PRESIDENT
1. To carry out the responsibilities as directed by the
President.
2. In the absence of the President the Vice-President specially
authorised by the President in writing, will preside over the
meeting. If no such direction has been made, any one of the
Vice-President or if all the Vice-Presidents are absent then the
Committee/Executive can call on any of its members present to
preside.
3. In place of the President, the Vice-President directed by the
President will discharge all the functions and powers of the
President.
GENERAL SECRETARY
1. To convene meetings as per the instructions of the President,
issue circulars and agenda as well as to organize the meetings.
2. To maintain the minutes of the meeting and to circulate it
among members.
3. To organize programmes, meeting, conferences, agitations and
to look after publicity.
4. To run the office of the Party and make necessary
appointments with the consent of the President.
5. To execute the decisions of the President and the Committee /
Executive.
SECRETARY : To discharge the functions allocated by the
President or on behalf of the President and to help the General
Secretary in his/her duties in the welfare of the Party.
TREASURER
1. To maintain the income and expenditure account of the
Committee/Executive.
2. To get the accounts examined/audited and to report the same
to the Committee annually.
3. To audit the accounts of all Subordinate Units.
4. To inform the Committee regularly the progress of the
accounts.
UNDER ARTICLE VII :
TECHNICAL/PROFESSIONAL CONSULTANCY WING
1. To maintain the receipts/expenditures at
Technical/Professional Consultancy Wing.
2. To raise funds from authorised/legal sources.
3. To arrange expenditures to be incurred by candidates standing
elections to the Central as well as State legislatures or/and as
the case may be.
4. To organize programmes, meetings, conferences and look after
publicity of the Technical/Professional Consultancy Wing.
5. To liaison with financial/Institutional establishments for
collections of donations / commissions etc.
CHAIRPERSON
1. To preside over the sittings of the Technical/Professional
Consultancy Wing.
2. To nominate, as per the Constitution, members/office bearers
in consultation with the Secretary of the Technical/Professional
Consultancy Wing.
3. To exercise any power of the Technical/Professional
Consultancy Wing, in an emergency, when it is not in session
provided that any such action will have to be approved in its
subsequent meeting.
4. To allocate the work and duties amongst the office-bearers
and members of the Technical/Professional Consultancy Wing on
advice from the Secretary of the Wing.
5. To take part in talks, discussions, debates with other
parties and to nominate representatives from the
Technical/Professional Consultancy Wing for the work.
SECRETARY
1. To convene meetings as per the instructions of the
Chairperson, issue circulars and agenda as well as to organize
the meetings.
2. To maintain the minutes of the meeting and to circulate it
among members.
3. To organize programmes, meeting, conferences, agitations and
to look after publicity.
4. To run the office of the Technical/Professional Consultancy
Wing and make necessary appointments with the consent of the
Chairperson.
5. To execute the decisions of the Chairperson and the
Technical/Professional Consultancy Wing.
JOINT SECRETARY
To discharge the functions allocated by the Secretary as
approved by the Chairperson and to help the Secretary in his
duties in the functioning of the Technical/Professional
Consultancy Wing.
REQUISITIONED MEETINGS
The number required for making a quorum for the Executive
Committee or Council Meetings, will be necessary for making a
joint representation to the concerned President specifying the
subject for which a requisitioned meeting is asked for. On
receipt of such a requisition, a Committee or Executive meeting
shall be called within ten days and a Council meeting within one
month.
PARTY FUNDS
1. Funds collecting receipts will be printed at the National and
State Levels only.
2. Each receipt will be duly numbered and issued in books
containing ten to hundred receipts.
3. Each receipt shall bear a facsimile signature of the
concerned Treasurer. The Counterfoil will be signed in full by
the member who collects the money.
4. Bank Account will be opened in the name of the Party upto a
Subordinate/Local Committee level to be jointly operated by any
two amongst the Treasurer, and the President or the General
Secretary of The unit.
5. Amount of Purse presented to a State Leader shall be divided
as under :
Subordinate/Local 15%
District 20%
State 25%
National 40%
In case where a purse has been presented to a Central Leader it
shall be remitted to the Centre.
6. Accounting year shall be from First April.
7. Annual Accounts of each Committee will be audited by a person
appointed by a resolution of the concerned Committee and
approved annually.
